The Reality

What California Restaurants Face

California food service means slip-and-falls, kitchen fires, alcohol exposures, and high staff turnover. These are the real problems we solve every day.

!

Slip-and-Fall Claims

Slip-and-fall is the #1 general liability claim in food service. One claim can exceed $100,000 — and most policies require you to fight them aggressively to control losses.

!

Liquor Liability Gaps

If you serve alcohol, liquor liability is required by ABC and most landlords — but it is excluded from most general liability policies. Carriers vary dramatically in how they write it.

!

Kitchen Fires & Equipment Breakdown

A grease fire or walk-in cooler failure can shut you down for weeks. Equipment breakdown coverage and proper business income limits are the difference between recovery and closure.

!

Food Spoilage From Outages

California rolling blackouts and PSPS events cost restaurants thousands per incident in spoiled inventory. Standard property policies often exclude this — a specific endorsement is required.

!

High Staff Turnover & WC Risk

Restaurant staff turnover drives workers comp claim frequency. Tipped employee wage calculations get audited frequently. Class code 9079 has specific underwriting rules we know cold.

The Complete Coverage Stack

The Coverage Stack Every Restaurant Needs

California restaurants need 6-8 coverages working together. Buying them piecemeal from different carriers creates gaps. We package them properly.

General Liability

Covers slip-and-fall claims, food-borne illness claims, third-party injury, and property damage. Slip-and-fall is the #1 GL claim in food service — limits and defense coverage matter. Most landlords require $1M-$2M minimum.

Most-required coverage in food service. Without it, you cannot lease most commercial spaces.

Workers' Compensation

Required by California law for any restaurant with employees. Most restaurants use class code 9079 (general restaurant). Tipped employee wages must be included in payroll for premium calculation — many restaurants underpay because of this and get hit with audit adjustments.

We audit your tip-wage reporting and class codes for free. Common audit adjustments save 10-20%.

Liquor Liability

If you serve alcohol — beer, wine, or spirits — California dram-shop laws make you liable for injuries caused by intoxicated patrons. Liquor liability is EXCLUDED from most general liability policies. Carriers vary widely; some won't write it at all, others charge 5x for the same coverage.

Required by ABC for all alcohol-serving establishments. We know which carriers write it well.

Property Insurance

Building (if owned), tenant improvements (if leased), kitchen equipment, furnishings, signage, and inventory. Replacement-cost coverage is critical — actual cash value leaves you short. Co-insurance penalties can cut claim payouts in half if you're under-insured.

Replacement cost + agreed value endorsement avoids co-insurance penalties on partial losses.

Equipment Breakdown

Walk-in coolers, freezers, HVAC, ovens, dishwashers, ice machines — when they break, you lose more in food spoilage and business interruption than the repair itself. Equipment breakdown pays for repairs PLUS resulting spoiled inventory and lost income.

Often the most-claimed coverage in restaurants. Pays for itself within 2-3 years for most operations.

Business Income

If a fire, equipment failure, or covered loss closes you for weeks, business income coverage pays your rent, payroll, and lost profits. Without it, even a 2-week closure can permanently sink a restaurant. Restaurants need 12-month minimum coverage periods.

Most overlooked coverage. We size limits based on your actual P&L, not industry averages.

Food Spoilage

Spoilage from power outages (PSPS, blackouts), refrigeration failure, or contamination. California's rolling-blackout grid means this happens. Standard property usually excludes spoilage — it requires a specific endorsement or standalone policy. Limits typically $5K-$50K.

Essential in California. We add it to every restaurant property policy by default.

Umbrella / Excess Liability

California is one of the most lawsuit-friendly states. A severe slip-and-fall or alcohol-related injury can quickly exceed your GL or liquor liability limits. Umbrella layers $1-5M on top of all primary liability coverages. Many landlords now require it on the lease.

Especially important for bars, nightclubs, and restaurants with full liquor service.

Most restaurants need 5-7 of these working together. We package them properly so there are no gaps and no double-coverage waste.

Broker vs. Direct-to-Consumer

Why Use a Broker for Restaurant Insurance

Buying restaurant insurance direct from a carrier means one carrier's product. We shop 50+ California carriers — including liquor liability specialists and food-service surplus markets — to build the right stack at the right price.

Liquor Liability Specialists

Carriers vary dramatically on liquor liability. Some won't write it. Others charge 5x for the same coverage. We have appointments with the carriers that write it well and price it fairly — for everything from beer-and-wine to full bars and nightclubs.

Tip-Wage Audit Defense

Workers comp audits frequently catch restaurants under-reporting tipped employee wages. We help structure your payroll reporting up front so audits don't sting at renewal. Most restaurants are mis-reporting by 10-15%.

Equipment Breakdown + Business Income Coordination

These two coverages need to work together. A walk-in cooler failure means equipment repair AND food spoilage AND days of closed business. We make sure they're properly coordinated, not bought separately with gaps.

Multi-Carrier Bid at Renewal

Every year at renewal we shop your full coverage stack across multiple carriers. Liquor liability especially gets less competitive each year if you don't shop it — claims-free restaurants leave money on the table.

California Restaurant Specifics

California Restaurant Compliance Specifics

The technical details that separate California restaurant insurance from generic small-business insurance. We handle all of this.

ABC License & Liquor Liability

California Alcohol Beverage Control requires proof of liquor liability coverage at license renewal. Coverage must remain in force or you lose the license. We file certificates with ABC directly and track renewals.

CalOSHA Heat & Kitchen Safety

California has the strictest commercial kitchen safety regulations in the country. Workers comp carriers audit safety protocols — failure can trigger surcharge audits. We help prepare safety documentation.

Health Department Compliance Certifications

Health department inspection failures can affect insurance underwriting. We help coordinate insurance with your health-permit status and document everything for renewals.

Tipped Employee Wage Reporting

California tipped employees receive minimum wage PLUS reported tips. Workers comp premium is calculated on total wages including tips. Mis-reporting is the #1 audit issue — we help get it right up front.

Patio & Outdoor Seating Endorsements

Outdoor patios, sidewalk seating, and parklets create additional GL exposure. Most carriers cover this by default but limits and exclusions vary. We review the policy language so there are no surprises.

Delivery & Catering Operations

If you deliver or cater, you need commercial auto and hired/non-owned auto liability. Employee delivery using personal cars is a major exposure most restaurants miss. We close this gap.

Workers Comp Class Codes

Restaurant Workers Comp Class Codes

Workers' comp premium = payroll × class code rate × experience modifier. Restaurant codes have specific underwriting rules (kitchen %, alcohol %, table service vs counter). We audit and place them correctly.

Frequently Asked

Restaurant Insurance FAQ

All California restaurants with employees must carry workers' compensation insurance. Most need general liability ($1M-$2M typical), property insurance for building and contents, and business income coverage. Alcohol-serving establishments need liquor liability per ABC requirements. Equipment breakdown and food spoilage coverage are highly recommended in California given the power-grid risks. Specific requirements vary by lease and ABC license type.

Costs vary by size, alcohol service, and menu. Typical ranges: General liability $1,500-$5,000/year for small operations. Workers' comp 4-8% of payroll for class code 9079. Liquor liability $400-$3,000/year depending on alcohol percentage. Property insurance varies wildly with building value and tenant improvements. A full restaurant package typically runs $5,000-$25,000/year for small to mid-sized operations.

Yes. California dram-shop laws apply to all alcohol service — beer and wine carry the same legal exposure as hard liquor. The premium is lower for beer-and-wine-only than for full bars, but the coverage is essential. ABC also requires proof of coverage regardless of license type. Most general liability policies EXCLUDE liquor liability entirely.

California workers comp premium is calculated on total wages PAID, which includes reported tips. Tipped employees receive minimum wage PLUS tips — both must be reported to your workers comp carrier. Many restaurants under-report by excluding tips, which triggers audit adjustments at year-end. We help structure reporting correctly up front so audits don't sting.

Outdoor patios and parklets are typically covered by your general liability with appropriate endorsements. Food trucks need a hybrid policy: commercial auto for the vehicle AND general liability + workers comp for food operations. Delivery operations require commercial auto and hired/non-owned auto liability — even if employees use their own cars. We coordinate all of this in one package.
