California Labor Code §3700 requires every employer with one or more employees to carry workers' compensation insurance, regardless of whether the employee is full-time, part-time, seasonal, or temporary. Non-compliance is a criminal offense punishable by fines up to $100,000, stop-work orders, and potential personal liability for all injury costs. Even a single uninsured day of employment is a violation.

California workers comp premium is calculated using this formula: (Payroll ÷ 100) × Classification Rate × Experience Modification Rate = Base Premium. Your payroll is the total wages paid, your classification rate is set by the WCIRB based on the type of work your employees do, and your experience mod reflects your claims history compared to similar businesses. We help you optimize all three factors to minimize your premium legally.

At the end of each policy year, your carrier conducts a premium audit to verify your actual payroll matched what you estimated when the policy began. If your payroll increased, you owe additional premium. If it decreased, you get a refund. The audit reviews payroll records, certificates of insurance from any subcontractors, and job classification accuracy. Your experience modification rate (ex-mod) is a multiplier applied to your workers comp premium based on your actual claims history compared to other businesses of your size and industry. An ex-mod of 1.0 is average. If your ex-mod is 0.85, you pay 15% less than the base rate — you have a better-than-average claims history. If it is 1.20, you pay 20% more.
